PEMBROKE SCHOOL DISTRICT
DRUG-FREE WORKPLACE POLICY
It is the policy of the
Pembroke School District to provide a drug-free environment for all employees.
In addition, as a recipient of federal grant monies, the Pembroke School
District is required by the Drug-Free Workplace Act of 1988 and government regulations
promulgated thereunder the enact a drug-free workplace policy and to certify to
federal agencies which provide grant monies that it will provide a drug-free
workplace. The Pembroke School District policy and certification is stated
below:
- Notify all employees in
writing through a written statement that the unlawful manufacture,
distribution, possession, or use of controlled substances is prohibited in
the school district’s workplace and specify the actions that will be taken
against employees for violation of such prohibitions.
- Maintain drug-free awareness
efforts through the certification/staff development process to inform
employees of the dangers of drug abuse and of the school district’s policy
of maintaining a drug-free workplace; any available drug counseling,
rehabilitation, and employee assistance programs; and the penalty that may
be imposed on employees for drug abuse violations occurring in the
workplace.
- Assure that employees,
inclusive of those funded by a federal grant and those engaged in the
performance of grants are notified of the statement as required by
paragraph 1 of this policy.
- Notify employees in the
required statement that as a condition of employment under the grant, the
employees will abide by the terms of the statement and will notify the
school district of any criminal drug statute conviction for a violation
occurring in the workplace no later than five days after such conviction.
- Notify the federal agency
within ten days after receiving notice from an employee or otherwise receiving
notice of such conviction.
- Take one of the following
actions within 30 days of receiving notice with respect to any employee
who is so convicted; take appropriate personnel action against such an
